This Client Service Agreement ("Agreement") is between MoJamoza Technologies ("we", "us") and the business owner who orders a store on MojaDuka ("you", "Client"). Placing an order and paying the setup fee described to you constitutes acceptance of this Agreement.
The one-time setup fee (as quoted to you, typically KES 5,000–7,000 depending on scope) includes: creation of your store on a MojaDuka subdomain, upload of your initial product catalog (as agreed at order time), your business logo and details, and one round of revisions before launch. Additional products, custom design work beyond the standard template, or extra revision rounds may be quoted separately.
After setup, your store is hosted for a recurring fee (currently KES 500/month, or a discounted annual rate if you choose to prepay). Your first month of hosting is free. Billing begins from the date agreed at setup and continues until you cancel.
If a hosting payment is not received by its due date, we will send a reminder and allow a short grace period. If payment remains outstanding after the grace period, your store will be temporarily suspended (taken offline with a "store unavailable" message) rather than deleted. Your store and data will be restored promptly once payment is received. Stores left unpaid for an extended period (as communicated to you at suspension) may eventually be archived and removed.
You own your business content — your product listings, photos, descriptions, logo, and customer data collected through your store. MoJamoza Technologies owns the underlying platform, software, and design template used to build and host your store. If you cancel, you're entitled to a reasonable export of your product and customer data on request.
Any customer information collected through your store (names, phone numbers, birthdays) is stored on your behalf, under your instruction, in line with our Privacy Policy. You are responsible for using this data appropriately and lawfully with your own customers — for example, only sending promotional messages to customers who've provided their details willingly.
As an active MojaDuka hosting client, your store is automatically eligible for a free listing on our public "Show Us What You're Selling" directory, unless you opt out. This benefit is tied to your store remaining active — a suspended or cancelled store's directory listing is removed along with it.
You agree not to use your store to list counterfeit, stolen, illegal, or prohibited goods, or to make misleading claims about your products or pricing. We may remove content or suspend a store that violates this section.
We may update store templates, features, or the underlying platform over time to improve the service. We'll aim to give reasonable notice of any change that affects how your store looks or works.
You may cancel at any time by notifying us. Cancellation takes effect at the end of your current billing period; we do not provide partial refunds for unused time within a billing period already paid for.
MoJamoza Technologies is not responsible for orders, payments, disputes, or deliveries arising between you and your customers — our role is to provide and host the storefront, not to process your sales. Our liability for any issue with the service itself is limited to the fees you've paid us in the three months preceding the issue.
This Agreement is governed by the laws of Kenya.
