These Terms of Service ("Terms") govern your use of MojaDuka (the "Platform"), operated by MoJamoza Technologies ("we", "us", "our") from Namanga, Kenya. By using the Platform — whether as a business owner with a hosted store, a shopper browsing a store, or a visitor to our public directory — you agree to these Terms.
MojaDuka lets small business owners in Kenya set up and host their own online storefront under a subdomain of mojamoza.com, and optionally list their business on our free public directory, "Show Us What You're Selling." We are a hosting and software service — we are not a party to any sale, order, or transaction between a store owner and their customers.
Each store is set up and administered on your behalf by MojaDuka under the terms agreed in your separate Client Service Agreement. You are responsible for the accuracy of the information, prices, and product descriptions displayed on your store.
You may not use a store or the directory to list or sell counterfeit goods, stolen property, prohibited or regulated items, or anything illegal under Kenyan law. We may remove listings or suspend a store that violates this section without prior notice.
Stores on MojaDuka use WhatsApp and M-Pesa for orders and payment between the shopper and the business owner directly. We do not process payments, hold funds, or guarantee delivery, quality, or refunds for any transaction. Disputes about an order are between the shopper and the business owner.
Listing on "Show Us What You're Selling" is provided free of charge to active MojaDuka hosting clients as described in your Client Service Agreement. We may remove a listing at any time, including if the associated store is suspended or cancelled.
We aim to keep stores online and accessible, but we do not guarantee uninterrupted availability. Scheduled maintenance, hosting provider issues, or non-payment (see your Client Service Agreement) may result in temporary downtime.
The Platform is provided "as is." To the fullest extent permitted under Kenyan law, MojaDuka and MoJamoza Technologies are not liable for indirect, incidental, or consequential losses arising from your use of the Platform, including lost sales, lost data, or disputes with customers or suppliers.
We may update these Terms from time to time. Continued use of the Platform after an update means you accept the revised Terms. Material changes affecting active clients will be communicated directly.
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms will first be addressed through good-faith negotiation between the parties before recourse to the courts of Kenya.
